General Provisions

These regulations define the rules for making purchases in the online store https://wood-slats.com/

Terms used in the regulations mean:

Customer - a natural person (having full legal capacity) who has made or intends to make a purchase in the online store https://wood-slats.com/ Only a Consumer can be a Customer;

Consumer - according to the Civil Code of April 23, 1964 - a User who, as a natural person, performs a legal act in the Store not directly related to their economic or professional activity. In the meaning of these Regulations, entrepreneurs conducting sole proprietorship, entering into contracts that do not have a vocational character resulting from the subject of their activity, are also Consumers;

The Store offers for retail sale via the Internet Decorative slats veneered with natural wood. The above products are available through the Store in the form of finished products or products made to the Customer's order.

Detailed information about the products is available on the website https://wood-slats.com/, as well as provided via email at the Seller's email address.

The Customer can contact the Seller by mail at the address indicated in point 2b and electronically at the email address:

Orders in the Store can be placed 24/7. Responses to customers' email messages, telephone contact with the Seller, and the processing of placed orders are carried out from Monday to Friday, from 8 AM to 4 PM.

§2

Terms of Service

To be able to place an order through the Store, the Customer must meet the following technical requirements:

have a computer, laptop, or other device with internet access;

have access to email;

use a web browser (Internet Explorer version 7.0 or newer, Mozilla Firefox version 3.0 or newer, Opera version 11.0 or newer, Google Chrome version 20.0 or newer, Safari version 5.0 and newer);

use a minimum screen resolution of 1024×768;

enable the ability to save cookies in the browser.

The online store provides electronic services in the form of Account Registration, User Account, and Order Form. The Store does not charge any fees for providing these services.

To use the Order Form, the customer selects the product of interest and then clicks the "Add to Cart" button.

Clicking the above button adds the selected product to the Cart. After adding a product to the Cart, the Customer can proceed to placing an order or continue shopping.

The above services are provided indefinitely. The Customer may at any time, without giving a reason, resign from the User Account service by sending an appropriate email message to the Seller's email address. The Customer may withdraw from the agreement for the provision of the Account Registration service, User Account, or Order Form within 14 days from the date of placing the order in the manner specified above.

§3

Concluding Agreements

The agreement is concluded between the Seller and the Customer.

All prices provided on the Store's website are gross prices (including VAT) specified in Polish zlotys. The product prices do not include shipping costs.

The Seller takes due care to ensure that the product photos reflect their color, character, texture, and condition. Product colors in photos may slightly differ from reality due to various factors, including different screen resolutions, calibrations, and brightness settings on the Customer's computer, on which the photos are displayed, or the use of flash photography. For this purpose, the Store includes a product description and color details alongside the photo. In case of doubt, please contact the Seller. Some products may slightly differ from the products in photos due to different production batches (e.g., a different shade of paint used) or due to the use of natural materials (e.g., differences in wood grain, distribution),

Orders can be placed via the Store's website using the Order Form (without registration) or through the User Account. The Seller does not conduct telephone sales.

The Store offers ready-made products as well as products for individual customer orders. Products for individual customer orders are divided into two groups:

Personalized products, i.e., customization of ready-made products at the Customer's request,

Products made entirely to the Customer's order.

To make a purchase, the Customer selects the desired products in the Store by clicking the "Add to Cart" button. Then, in the "Cart" preview, the Customer can select the quantity of products. After selecting the products, the Customer moves to the tab where the method of product delivery is specified.

Next, the Customer clicks the "Order and Pay" button, which redirects the Customer to a page containing information about the placed order. This information includes, among others: the main characteristics of the ordered goods, the total price including taxes and delivery charges, and the Customer's personal data provided in the order form.

In order to place an order, the Customer must confirm the order by clicking the "Order and Pay" button located below the order summary.

Clicking the "Buy and Pay" button is equivalent to the Customer's declaration of knowledge about placing the order, which entails the obligation to pay.

The sales contract is concluded upon the Customer's confirmation of placing the order, i.e., upon clicking the "Buy and Pay" button.

The payment deadline is the day on which the payment should be credited to the Seller's account.

The condition for using the Order Form is confirming familiarity with the content of these regulations and its acceptance.

After placing an order by the Customer, the Seller sends a confirmation email for the order to be processed, along with details regarding its fulfillment, including, among others: the main characteristics of the ordered goods, the order fulfillment period, the total price including taxes and delivery charges, and the Customer's personal data provided in the order form.

The content of the contract is preserved, secured, and made available through:

recording the contract content in the Store's computer system

The Seller reserves the right to refuse the fulfillment of an order under the sales agreement if the Customer's contact details are untrue.

§4

Payment Terms and Methods

The online store provides the following payment methods for orders:

The Customer is obliged to make payment or collect the goods for orders with personal pickup within 5 business days from the day of purchase.

In the case of custom orders, the only accepted payment method is a prepayment.

In the case of the delivery method mentioned in §5 section 3b, the only accepted payment method is a prepayment. For the delivery method mentioned in §5 section 3a item i, the Customer can choose either advance payment or cash on delivery.

In the event of a refund for a transaction made by the customer using a payment card, the Seller will issue a refund to the bank account linked to the Customer's payment card.

§5

Delivery Methods and Costs

The Customer bears the costs of delivering the ordered products to the destination.

Products are delivered to the specified address within the territory of the Republic of Poland and abroad. The delivery charges for products are provided in the panel and in the order confirmation email.

The online store offers the following delivery methods:

The order processing time is up to 10 business days from the date of payment confirmation for the ordered goods on the Seller's account (or, in the case of payment by payment card as mentioned in §4 section 1c, from the moment of obtaining a positive payment authorization). For custom products, the Seller will indicate the production deadline in a separate email.

§6

Right of Withdrawal

The provisions in this section pertain to rights granted exclusively to the Consumer.

The Consumer has the right to withdraw from an agreement concluded with the Seller within 14 days from the day of receiving the shipment or personally collecting the goods, without stating a reason.

The Consumer may submit a statement of withdrawal from the agreement using the withdrawal form located at the end of these terms and conditions, either by mail to the address:

Submitting a statement of withdrawal without using the provided form does not affect the effectiveness of the withdrawal. Sending the statement before the deadline is sufficient for the withdrawal to be valid.

The Seller promptly confirms the receipt of the withdrawal statement by email (to the address provided during order placement) and acknowledges it.

The Consumer must return the purchased products within 14 days from the date of sending the withdrawal statement to the Seller's address.

In the event of submitting a statement of withdrawal from the agreement, the agreement is considered null and void.

The Consumer bears the direct costs of returning the purchased products.

The Consumer is liable for any diminished value of the goods resulting from handling them in a way that goes beyond what is necessary to establish the nature, characteristics, and functioning of the goods, for instance, costs of cleaning, repairing parts, tearing labels. To establish the nature, characteristics, and functioning of the goods, the Consumer should handle and inspect the goods in the same manner as they could in a physical store.

The Seller is obliged to refund the Consumer all payments made by them, including the delivery cost of the product (excluding additional costs resulting from the Customer's choice of a delivery method other than the least expensive ordinary method offered by the Store), without undue delay, and in any event no later than 14 calendar days from the day on which the Seller is informed about the Consumer's decision to withdraw from the agreement. The Seller will issue the refund using the same means of payment used by the Consumer, unless the Consumer explicitly agrees to a different method.

The Seller may withhold the refund until the goods are received back or the Consumer supplies evidence of having sent back the goods.

The right of withdrawal does not apply to agreements in which the subject of the service is a product made to individual order, i.e., a non-prefabricated product manufactured according to the Consumer's specifications or serving to meet their individualized needs. All products specified in §3 section 6 are considered products made to individual order.

§7

Complaints Due to Warranty for Defects

The Seller is obligated to provide products free from physical and legal defects.

The Seller's liability for physical or legal defects expires after two years from the day of product delivery. Before the expiration of this period, the Consumer can notify the Seller of a defect by sending an appropriate email to: contact@wood-slats.com

The Consumer is not bound to the above methods of filing a complaint. They can submit a complaint report in any manner, provided that a durable medium is used.

Knots, gloss, and whiteness are characteristics of natural wood and not defects.

The complaint report should include:

the name and surname or the company name of the buyer;

the address of residence/registered office for correspondence;

an attached proof of product purchase (e.g., receipt, invoice, bank transfer confirmation, etc.);

precise designation of the disputed product;

description of the defect indicating the non-conformity of the goods with the agreement and the date of its occurrence;

the complainant's demand (withdrawal from the agreement, price reduction, product exchange, defect removal);

the date of complaint submission and the complainant's signature.

The Seller acknowledges the receipt of the complaint and requests the Consumer to promptly deliver the defective product to the Seller for further handling.

In case the complaint is not acknowledged, the product will be returned to the Consumer along with an opinion on the unjustifiability of the complaint.

If the Seller does not respond to the Consumer's complaint within 14 calendar days from the date of receiving the complaint, it is assumed that the Seller has accepted the Consumer's complaint and their request.

§8

Agreements with Entrepreneurs

The provisions of this section apply exclusively to agreements concluded with Customers who are entrepreneurs.

Placing an order on behalf of a legal entity or an organizational unit without legal personality is equivalent to a declaration that the person placing the order is authorized to represent the entity on whose behalf the order is placed. Placing an order without proper authorization will result in the person placing the order being liable for any damages arising from this fact.

The entrepreneur is obliged to inspect the shipment delivered to them via the carrier in the usual manner, and in case of any loss or damage to the product, they are required to take all actions to determine the carrier's liability.

The entrepreneur loses their warranty rights if they do not inspect the goods in a timely and customary manner for goods of this kind and do not immediately notify the Seller of the defect. In the case where the defect becomes apparent only later, the entrepreneur must notify the seller immediately upon its discovery.

The Seller reserves the right to terminate an agreement concluded with an entrepreneur within 14 days from the day of its conclusion without stating reasons.

Any disputes arising from the execution of an agreement concluded between the Seller and an entrepreneur will be resolved by a court with jurisdiction over the Seller's registered office.

In accordance with applicable regulations, after issuing a VAT invoice or receipt to the data provided by you during the order placement, we do not have the ability to add a VAT number. If you do not provide a VAT number before issuing the VAT invoice or receipt, it will be issued to the individual specified in the order form.

§9

Out-of-Court Dispute Resolution Methods

In order to resolve a dispute arising in connection with making purchases in the Store, the consumer has the option to seek assistance from the following institutions by filing a case in a common court:

utilizing a permanent consumer arbitration court as specified in the Act of 15 December 2000 on Trade Inspection by submitting an application for resolving a dispute arising from a sales agreement;

applying to the Voivodship Inspector of Trade Inspection with a request to initiate a mediation procedure to amicably settle the dispute;

seeking assistance from a district or municipal consumer advocate or a social organization whose aim is to protect consumer rights.

Detailed information on the consumer's options to use out-of-court dispute resolution methods and the availability of procedures is available at the headquarters and on the websites of institutions such as Trade Inspection, district (municipal) consumer advocates, social organizations dealing with consumer rights protection, as well as the Office of Competition and Consumer Protection.

The internet platform for resolving disputes between consumers and entrepreneurs at the EU level (ODR platform) is available at http://ec.europa.eu/consumers/odr. The ODR platform is an interactive and multilingual website with a comprehensive service point for consumers and entrepreneurs seeking out-of-court resolution of a dispute concerning contractual obligations arising from an online sales agreement or a service agreement.

§10

Final Provisions

The Seller reserves the right to amend this Terms and Conditions due to changes in the provisions of the applicable law or changes in the method of entering into and performing agreements. These changes will not affect orders or agreements placed, executed, or fulfilled.

Matters not regulated by these Terms and Conditions are subject to the provisions of the generally applicable law, in particular the Civil Code of 23 April 1964 and the Consumer Rights Act of 30 May 2014.

The provisions granting rights to Users who are entrepreneurs conducting individual business activity and performing legal actions through the Platform for non-professional purposes come into effect on 1 June 2020.

These Terms and Conditions are effective from 26 April 2021.
